Why Is Malcolm Jamal Warner’s Widow Suing His Mother, and Can She Win?

The lawsuit against actor Malcolm Jamal-Warner’s mother should serve as a reminder to everyone to update estate plans and other documents regularly, lawyers say.

On July 20, Tenisha Delilah Warner, “The Cosby Show” star’s widow, filed a lawsuit against the actor’s mother, Pamela Warner, claiming she’s owed more than $1.2 million under a premarital agreement.

The agreement included a $1 million life insurance policy that was never put in place by her late husband, $16,000 tax-free each year on their wedding anniversary, Roth IRA funding for as long as they remained married, and $5,000 monthly for serving as his chief of staff and assistant. The actor died in July 2025, and his mother is successor trustee of the Warner Family Trust.

The revocable Warner Family Trust left nothing to the Emmy-nominated actor’s widow or his 9-year-old daughter because it was established in 1996 and never updated to reflect his new family, the widow said. The couple met in 2015 and married in 2017, the same year their daughter was born.

The trust leaves 70% of Malcolm-Jamal Warner’s assets to his mother, 15% to his late father, Robert Warner Jr., and 15% to his half-sister Collage, according to a legal petition Tenisha Warner filed. “This was not Malcolm’s intent,” she said.

Although the high-profile case involves a trust, “this is not a trusts and estate issue,” said Patrick Simasko, elder law attorney and financial adviser at Simasko Law. “It’s a prenuptial agreement, which is a contract. They had a prenuptial agreement. He promised to leave her a million-dollar life insurance policy and a few other things and did not follow through.”

Can Tenisha Warner Win?

Since the prenuptial agreement is a legally binding contract, lawyers generally think Tenisha Warner has a strong case to say she is owed the money promised in the agreement.

Where the funds will come from to pay the debt is murkier. The actor’s total estate value was estimated between $3.4 million and $6 million when he died in an accidental drowning off the coast of Costa Rica at age 54. However, it’s unclear how much would be available to pay the money Tenisha Warner says she’s owed, lawyers said. Much of his wealth reportedly is linked to the trust.

Warner has said she doesn’t believe the actor’s personal estate outside the trust has enough money to cover the alleged debt, which is why she’s asking the trust to pay it. She’s also asked to freeze trust distributions until the matter is settled.

Since the trust is revocable, Venable LLP partner Larry Mandelker said Warner will likely be able to tap the trust funds for her payout.

“The trust is revocable,” Mandelker said. “It was under his control during life, so it’s subject to creditor claims. She has a valid contractual claim, the same as if he owed the IRS money or credit card money.”

Revocable vs. Irrevocable Trusts

If the family trust were an irrevocable trust, it would have had more protections against creditors, Mandelker said.

An irrevocable trust holds assets that you no longer own so your creditors can’t claim them. They generally cannot be changed or dissolved easily. Since you no longer own the assets, you’re not responsible for the taxes. The trust also avoids probate and is private, so the trust terms or the assets held within them aren’t publicly known.
A revocable trust, on the other hand, remains yours. You own the assets and pay taxes on them and maintain total control during your lifetime, so creditors can claim against these assets. However, the trust avoids probate court after death. A revocable trust is like the “alter ego of a person,” Mandelker said.

What Can People Learn From the Malcolm Jamal Warner Case?

The lawsuit could have been avoided had the actor updated his trusts and estate documents after he married, lawyers said. He could have made his intent clear and left no gap in his plans. He also could have followed through on his prenuptial agreement and bought a life insurance policy, funded IRAs and fulfilled the other obligations he allegedly promised.

Warner “will probably win, but this happens all the time,” Simasko said. “Guys marry … and don’t update their estate plan. That happens every day. Every day. The moral of the story is when you get married, update your stuff right away.”
