A crucial vote on the Digital Asset Market CLARITY Act may take place this week in the Senate. However, the way forward hinges on one condition. The leadership in the Senate has to first move for cloture, which is scheduled for Wednesday. If it does, it will probably be Friday at the latest for a cloture vote.
CLARITY Act Nears Senate Vote On Friday
Lawmakers will reconvene on August 3, but the crypto bill is still not on the Senate floor schedule. The Senate calendar has a 5:30 p.m. cloture vote. But that is a vote on H.R. 6500 and not H.R. 3633, the CLARITY Act. A formal announcement of a cloture motion or final floor vote on the crypto market structure bill has not been made yet.
On this, crypto analyst Ted Pillows said the timeline is becoming tighter before Congress begins its August recess. He wrote, “If Senate leadership waits until Wednesday to file cloture, a procedural step required to move the bill forward, the earliest vote would likely be Friday.”
Pillows also warned that the delay would leave “very little time” for senators to begin debating the legislation before leaving Washington. He added that “unless Senate leaders speed up the process through a unanimous consent agreement or another procedural shortcut, the window to advance the Clarity Act before the recess is quickly closing.”
The Clarity Act is still not on the Senate’s floor schedule, making it increasingly difficult for lawmakers to pass the bill before the August 10 recess.

Chainlink Senior Director of Communications Chris Barrett suggested that a vote this week remains possible. He posted, “The cloture vote on Clarity Act has not been ruled out for this week.” Responding to questions, Barrett added, “It means that a Senate vote to end debate on the Clarity Act could still happen this week, but it hasn’t been scheduled or confirmed yet.”
The CLARITY Act was passed in July 2025 by the House in a vote of 294-134. Later, it passed the Senate Banking Committee with a bipartisan vote of 15-9 in May of 2026.
After Senate Banking and Agriculture Committee work, Senator Cynthia Lummis also released the revised text of the crypto bill on July 22.
Recently, last week, Lummis confirmed a procedural vote for CLARITY Act will take place this week.
What Happens If The Cloture Is Filed?
If Republicans are even going to get a cloture vote, they will have to have votes of the Dems. In the Senate, 60 votes are normally needed to vote to end debate on a bill. It requires all 53 Republican votes to advance. On Democrat side, at least seven are required to overcome procedural hurdle to move the bill to debate.
The passage of the bill this year appears to be less likely. Hence, Bernstein analysts believe that if the CLARITY Act fails, the CFTC and SEC will still move forward with crypto rulemaking under the project.
