FTC Says Some “Made in the USA” Claims May Mislead Shoppers

When you see a product labeled “Made in the USA,” it’s natural to feel confident that your purchase supports domestic workers and American manufacturing. However, the Federal Trade Commission (FTC) has recently stepped up its efforts to alert consumers that not every label tells the full story. As part of a heightened enforcement priority, the agency is cracking down on companies that use deceptive marketing to imply domestic origin when a significant portion of their production actually happens overseas. Here is what you need to know about the latest FTC crackdown.

Understanding the “All or Virtually All” Standard

For a product to legitimately carry an unqualified “Made in USA” claim, it must meet the FTC’s strict “all or virtually all” standard. This means that virtually every component and processing step involved in creating the product must originate within the United States.

Not every U.S.-origin claim means the same thing. An unqualified “Made in USA” claim generally means the product is “all or virtually all” made in the United States. By contrast, phrases such as “Assembled in USA” or “Made in USA with imported parts” communicate that at least some significant components or manufacturing occurred outside the country. Those qualified claims aren’t necessarily misleading. They simply describe a different level of domestic content.

Implied Claims and Patriotic Marketing

The FTC evaluates the overall impression created by advertising, not just individual words. That means flags, maps, red-white-and-blue packaging, hashtags, website copy, or references to American craftsmanship can all contribute to an implied “Made in USA” claim if they would reasonably lead consumers to believe a product is domestically made.

How the FTC Is Protecting Your Wallet

In recent months, the FTC has launched aggressive enforcement sweeps, resulting in significant settlements and consumer redress. Companies ranging from footwear manufacturers to dartboard sellers have been held accountable for falsely labeling foreign-made goods. These actions send a clear message that businesses must conduct thorough due diligence before making any domestic origin claims.

The FTC’s latest enforcement effort included warning letters to several companies that appeared to market imported products as “Made in the USA” or even “Made in Texas.” Earlier this year, the agency also announced settlements involving companies accused of making deceptive U.S.-origin claims, underscoring that domestic-origin advertising remains a major enforcement priority.

If You Think a Claim Is Misleading

Save photos of the product.
Keep your receipt.
Take screenshots of online advertisements.
File a complaint through the FTC’s online reporting system.
Contact your state attorney general if appropriate.

Identifying Genuine American-Made Products

When you are shopping, keep in mind that many products sold in the U.S. have no legal requirement to carry a country-of-origin label at all—unless they are specific categories like automobiles, textiles, or furs. If a company chooses to make a “Made in USA” claim, they must have reliable evidence to substantiate it. If you suspect a product’s origin claims are dishonest, you can file a complaint directly with the FTC through their official website.

Country-of-origin labeling requirements vary depending on the product category and the laws that apply. In many cases, companies voluntarily make U.S.-origin claims, but once they do, those claims must comply with FTC standards and be truthful and substantiated.

Before You Buy

Read the complete origin statement, not just the front of the package.
Look for qualified phrases like “Made in USA with imported parts.”
Be cautious if patriotic imagery is used without a clear origin claim.
Check the company’s website for manufacturing details.
If origin matters to you, don’t hesitate to ask the retailer for clarification.
