The US Supreme Court on June 30 issued one majority opinion that covered two relatedthat neither West Virginia nor Idaho violated the Constitution’s equal protection clause by barring transgender athletes (biological males who “transitioned” to female) from participating in girls’ sports.
Associate Justice Brett Kavanaugh authored the opinion for the majority.
“The question before the Court is: Under Title IX and the Equal Protection Clause of the Fourteenth Amendment, may schools maintain women’s and girls’ sports for biological females? In other words, may schools determine eligibility for women’s and girls’ sports based on biological sex? The answer is yes.”
